What is a birth certificate ? It is a document issued by the corresponding Civil Registry or Consulate, which certifies the fact of birth, date and time at which it took place, as well as the identity data of the registered person, including name and surname, sex, affiliation, among others.
Article 4 of the Civil Registry Act establishes that, among other things, births are registrable . Each person will have an individual register in which the facts and acts relating to identity, marital status and other circumstances will be recorded. The individual register will be opened with the registration of birth.
The birth registration certifies the fact, date, time and place of birth, identity, sex and, where list of contact numbers in philippines applicable, parentage of the person registered.
How is birth registration carried out?
Birth registration shall be carried out by virtue of a declaration made in an official document duly signed by the declarant(s), accompanied by the medical report. To this end, the doctor, the nurse specialising in obstetric-gynaecological nursing or the nurse who assists at the birth, inside or outside the health establishment, shall verify, by any of the means permitted by law, the identity of the mother of the newborn for the purposes of including her in the medical report.
Parents will make their declaration by completing the corresponding official form , which will contain the appropriate warnings about the value of such declaration in accordance with the regulations on legal determination of parentage.
The Civil Registry Officer , once the documentation has been received and examined, will immediately register the birth.
In all birth registrations made in Spain, maternal filiation must necessarily be recorded , although access to it will be restricted in cases where the mother so requests for justified reasons and provided that she renounces exercising the rights derived from said filiation (except in the cases of art. 48 of the Civil Registry Law).
What happens with paternal filiation ?
a) When the marriage with the mother is duly accredited and is in accordance with the presumptions of paternity of the husband established in civil legislation or, even if those are lacking, in the event that the consent of both spouses is present, even if there is a legal or de facto separation.
b) When the father expresses his agreement to the determination of such filiation, provided that it is not contrary to the presumptions established in civil legislation and there is no dispute. The conditions provided for in civil legislation for its validity and effectiveness must also be met.
Once the registration has been completed, the Officer will issue an electronic literal certification of the birth registration and make it available to the declarant or declarants.
